Contract for Purchase of Goods
1a) The terms "Fine Gourmet Deli", "We", "Us" or "Our" refer to Fine Gourmet Deli, ABN 85310773673 whose registered trading premise is at 465 Centre Rd. Bentleigh, 3204, Victoria, Australia. In general, all purchases made on this website are governed by the following Terms and Conditions; however, these Terms and Conditions are subject to change at any time. If any purchase is made after we have published changes to these Terms and Conditions, you will be bound by those changes in effect at the time of purchase. You should check these Terms and Conditions prior to each purchase to ensure that you understand the precise obligations of each party. We will display the date and time each instant updates are made to these Terms and Conditions to assist you in determining what Terms and Conditions are valid at the time of purchase.
1b) Confirmation of acceptance of your purchase will be made by a message immediately after you accept your order during checkout online. We will also dispatch an email to your email address that you provided at the time of purchase as a confirmation that your order has been accepted. When acceptance has been made after checkout, you are explicitly agreeing to a contract for the purchase of goods. Under this contract, we will supply the goods to you in accordance with your order subject to these Terms and Conditions. Since all offers posted on this site are offers to treat, we have the right to reject acceptance even after the automated message and email response has been sent. In the event we do not accept your order, payment will be fully refunded.
1c) Fine Gourmet Deli trades from a licensed premise 465 Centre Rd. Bentleigh, 3204, Victoria, Australia. To purchase goods from our website you must be 18 years of age. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. The courier will only allow adults over the age of 18 to accept alcoholic products on delivery. In some circumstances, proof of age will be required in order to sign for deliveries containing alcohol. Once the delivery is accepted, responsibility is transferred to the recipient. All deliveries containing alcohol will be marked with a label.
Price and Shipping Costs
2a) The prices quoted on our website are all displayed in Australian dollars (AUD) and include all applicable taxes such as GST. The site accepts payment through a PayPal account. Payment is made via debit/credit card. You will require a PayPal account to purchase our products.
2b) All prices listed on our website are subject to change at any time. The cost of goods will be displayed on the website during checkout, showing any inclusive tax plus shipping. Shipping costs are charged on top of the listed price. Shipping costs are subject to change at any time. They are specified during checkout. A minimum order of $100 AUD is required for any purchase not including shipping costs.
Availability and Description of Products
3a) The descriptions and images displayed on our website are as accurate and reliable as we can make them. Every effort is made to ensure that they stay that way. However, because manufactures often alter packaging and even quantity you may in rare circumstances receive a product that does not appear the same as it did in its photo. In such cases, we ask that you contact us so that we can rectify the inaccuracy. If you have any enquiries, you are free to contact us.
3b) We accept no liability for the information presented in the descriptions regarding the ingredients of the product. Before consuming any product, you should always read the labelling.
3c) Stock levels displayed on our website are regularly updated, however, Fine Gourmet Deli will not be held responsible if any products are unavailable at the time of purchase. Because we trade both over the counter and through the internet a product that was displayed as being available online might have actually been sold over the counter. If such a situation occurs and a product is unavailable at the time of purchase, we will contact you prior to dispatch. If you wish, we may provide a similar product of equal value in its place. We might also be able to supply you with a similar product of greater value at our discretion. If you do not wish the situation to be rectified in this manner or there is no alternative replacement available, we shall provide you with a refund for the specific item in question, or a replacement product of equal value, or a full refund for the entire order.
4a) If you have any complaints you must make them in writing by email or mail and provide your full details as well as your order reference number.
5a) Promotional offers may be altered or removed at any time without prior notice. Since all offers displayed on our site are in fact offers to treat, individuals purchasing products on our sight do not have the ability to accept, that right lies with us alone.
5b) We have the ability to provide discounts to anyone we desire at our discretion.
6a) Orders may be cancelled at any time by phone or email. You must provide us with at least 24 hours notice before your order is scheduled for dispatch. Late cancellations may result with us inadvertently shipping your order. If such a situation occurs you will be held responsible for the cost of shipment. Please see clause 6b.
6b) If your order has been dispatched you must return the goods to us, at your expense, before any refund is issued. The goods must be in a new and unopened condition. The products must be returned in the same or similar packaging. The goods are your responsibility until they are delivered to us. When we receive the products and determine that they are in good condition, we will then issue you a refund minus a fee equal to the cost of shipment.
6c) If they have been damaged or become defective in some way a refund will not be issued. We will notify you of the situation and you may have the option of having the items sent back to you at your expense.
6d) The right to return does not apply to "perishable" items after they have been dispatched.
Incorrect and Defective Goods
7a) If you live within the Melbourne Metropolitan area and you received an incorrect or defective item, we will issue you a refund for that incorrect or defective item. However, you must contact us within 24 hours after delivery for incorrect or defective goods. We will make arrangements on your behalf for our courier to pick up the defective or incorrect goods. Perishable items must be kept refrigerated at all times; you cannot return a defective perishable item.
7b) If you live outside of the Melbourne Metropolitan area and your goods have been sent via Australia Post then responsibility is transferred to you, the purchaser, the moment Australia Post takes hold of the consignment. If the goods have become defective as a consequence of their shipment we cannot be held responsible. Perishable items must be kept refrigerated at all times; you cannot return a defective perishable item.
7c) If you received incorrect goods and live outside of the Melbourne Metropolitan area you should return them via regular Australia post and we will issue you a refund for those goods including return delivery. If there are any problems, you should call us immediately.
7d) Please note perishable items must be consumed by their "Use By" date indicated on the packaging.
7e) If you need to return an item, simply login to your account, view the order using the "Complete Orders" link under the My Account menu and click the Return Item(s) button. We will notify you via e-mail of your refund once we have received and processed the returned item. If you made your order via phone then please call us.
8a) When you place an order with us either over the phone or online it is your responsibility to ensure that the details that you have provided are true and correct. If it turns out that the details are incorrect and the goods are delivered to the wrong address we cannot be held responsible.
8b) When you place an order with us you are providing us with the authority to leave the goods at the location specified by you either over the phone or online during the checkout process. We cannot be held responsible for the goods once they have been shipped.
Placing an Order
9a) You may make a purchase at any time by simply going through the checkout process. Your order will be shipped within 72 hours after payment is received, using the shipment method that you selected during the checkout process. However, if you place your order on Thursday or Friday shipment may take place on Monday. In any event we will inform you either by email or phone when we will be shipping your purchased items.
Duration and Delivery Areas
10a) We provide a courier service for those individuals who live within a radius of 50km from Bentleigh. All individuals who live outside of this area will receive their order by Australia post; you may incur a higher delivery cost. If you live outside of the Melbourne metropolitan area such as in country Victoria or in another state call the number provided within the "contact us" section to check if delivery is possible. We retain the right to refuse delivery to anyone at all times. If a purchase is made and delivery is not a possibility, we will refund your money.
10b) The duration of delivery will depend upon your choice of shipment method. If you live within the Melbourne metropolitan area and you requested our courier service, delivery will be made within 72 hours of payment being received. Duration of delivery by Australia post can be located on their site.
11a) Courier: We can deliver to your home or place of work, or to the home or place of work of your relatives or friends. We always prefer to deliver your goods to a daytime delivery address, in other words a location where there will be someone to collect. We deliver any time during the hours of 9am to 5pm weekdays, excluding public holidays. In the event that the receiver is not home, the driver will follow the instructions provided during the checkout process.
You must provide alternative delivery instructions such as “leave at rear of house or with our next-door neighbour”.
If you elected to have the driver leave the consignment in a safe spot, he will do so. If it is not safe to do so, then the driver will leave a card with a phone number on it and return the consignment to us. When the receiver arrives home, they need to then call the number on the card and request the order to be redelivered at a convenient time. The receiver can also collect their consignment from us if convenient.
11b) Australia Post: If you elected to have the order shipped by Australia post you will most likely have to collect the shipment from your nearest Australia post store.
12a) "Perishable items" are goods that require refrigeration and are listed as such in the product description. They will require refrigeration as soon as they are delivered. If you requested the goods to be left with someone, you should advise them that they should refrigerate the items upon delivery. We will not be held responsible if the goods spoil. The package will be marked "Perishable".
